Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the ISP Security website or engaging our services.

Agreement to Terms

By accessing our website or using our services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you disagree with any part of these terms, you may not access our website or use our services.

Services

ISP Security provides cybersecurity consulting services, including but not limited to:

  • Penetration testing and vulnerability assessments
  • Security audits and compliance reviews
  • Network security assessments
  • Web application security testing
  • Security consultation and advisory services

All services are provided subject to the terms of individual service agreements, proposals, or statements of work (“SOW”) executed between ISP Security and the client.

Service Agreements

Specific terms governing the provision of penetration testing and security services will be outlined in individual service agreements or statements of work. In the event of any conflict between these Terms and Conditions and a signed service agreement, the service agreement shall take precedence.

Eligibility

You must be at least 18 years of age to use our services or enter into any agreement with ISP Security. By using our services, you represent and warrant that you meet this age requirement.

Account Registration

When you create an account with us or engage our services, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Intellectual Property Rights

The content on our website, including text, graphics, logos, images, and software, is the property of ISP Security or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

All reports, documentation, and deliverables created by ISP Security during the provision of services remain the intellectual property of ISP Security until full payment is received, at which point specified deliverables will be transferred to the client as outlined in the service agreement.

Confidentiality

ISP Security agrees to maintain the confidentiality of all client information, systems, and data accessed during the provision of services. Clients agree to maintain the confidentiality of all methodologies, tools, and proprietary information disclosed by ISP Security.

Confidential information does not include information that:

  • Is publicly available through no breach of this agreement
  • Was rightfully in the receiving party’s possession prior to disclosure
  • Is independently developed without use of confidential information
  • Is required to be disclosed by law or court order

Acceptable Use

You agree not to use our website or services to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit harmful code, viruses, or malicious software
  • Attempt to gain unauthorised access to our systems or networks
  • Interfere with or disrupt our services
  • Use our services for any illegal or unauthorised purpose

Testing Authorisation

Clients engaging penetration testing services must:

  • Have proper authorisation to request testing on all target systems
  • Provide written authorisation for all testing activities
  • Ensure all stakeholders are aware of testing activities
  • Obtain necessary permissions from third-party service providers where applicable

ISP Security will not conduct any testing without proper written authorisation. Clients are solely responsible for ensuring they have the legal right to authorise such testing.

Limitation of Liability

To the fullest extent permitted by law, ISP Security shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from our services shall not exceed the amount paid by the client for the specific service giving rise to the claim.

Professional Disclaimer

ISP Security provides security testing and assessment services to identify vulnerabilities and security weaknesses. However:

  • No security assessment can identify all vulnerabilities
  • Testing is performed at a specific point in time
  • New vulnerabilities may emerge after testing is completed
  • Implementation of recommendations is the client’s responsibility
  • ISP Security does not guarantee that systems will be secure after testing

Indemnification

You agree to indemnify, defend, and hold harmless ISP Security, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:

  • Your use of our services
  • Your violation of these Terms and Conditions
  • Your violation of any third-party rights
  • Any unauthorised testing or access conducted without proper authorisation

Payment Terms

Payment terms for services will be specified in individual service agreements or invoices. Unless otherwise stated:

  • Invoices are due within 30 days of the invoice date
  • Late payments may incur interest charges
  • ISP Security reserves the right to suspend services for non-payment
  • All fees are exclusive of applicable taxes

Cancellation and Refunds

Cancellation and refund policies will be outlined in individual service agreements. Generally:

  • Cancellations must be provided in writing
  • Cancellation fees may apply for scheduled services
  • Work completed prior to cancellation will be charged
  • Refunds are provided at ISP Security’s discretion

Report Handling and Disclosure

Security assessment reports contain sensitive information and must be handled appropriately:

  • Reports are confidential and for the client’s internal use only
  • Clients may not publicly disclose report contents without written permission
  • ISP Security may retain copies of reports for record-keeping purposes
  • Clients are responsible for securing report contents

Responsible Disclosure

If vulnerabilities are identified in third-party systems or products during testing, ISP Security will work with the client to ensure responsible disclosure practices are followed, including appropriate notification timeframes and coordination with affected vendors.

Third-Party Services

Our website and services may contain links to or integrate with third-party services. ISP Security is not responsible for the content, privacy practices, or services of third parties. Your use of third-party services is at your own risk.

Warranties and Disclaimers

Our services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

ISP Security does not warrant that:

  • Our services will be uninterrupted or error-free
  • Defects will be corrected
  • Our services are free from viruses or harmful components

Force Majeure

ISP Security shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labour disputes, or government actions.

Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify you of any changes by posting the updated Terms on this page and updating the “Last Updated” date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms and Conditions or our services shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes may be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any service agreements, constitute the entire agreement between you and ISP Security regarding the use of our services and supersede any prior agreements.

Waiver

No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term, and ISP Security’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms and Conditions or any rights granted hereunder without our prior written consent. ISP Security may assign these Terms and Conditions without restriction.
